Tax Planning Aiding Timely Tax Returns

Taxes” defined as an involuntary fee levied on corporations or individuals are enforced by the government in order to finance government activities. For the investing world there are a number of taxes such as toll, tribute, tallage, gabel, impost, duty, custom, excise, subsidy and supply. However, the most important types of taxes and highly debated one is the capital gains tax represents the tax paid on the increase in value made on an investment. Just as government loves taxes the people hate them and find means to avoid tax payments leading to penalities.

Whether its business taxes or individual tax, this has its beginings over 3,000 years ago with the earliest records of taxes comes from the ancient Egyptians. Further, as international trade and mercantilis opened up, governments came up with tariffs and income taxes to tweak the balance of trade. With globalization leading today’s business across geographies, efective becomes the need of the hour both for the idividuals and corporate tax payers. However, being an enforced contribution individuals at time fails to pay the taxes within the stipulated time period is subjected to punishment. How To Get Medical Insurance For A Surrogate Mother

Getting surrogate insurance coverage, that is, medical insurance to cover the surrogate pregnancy, can be tricky. There are a few different options for obtaining practical surrogacy insurance, depending on the situation of the surrogate mother and intended parents.

First, if at all possible, plan to use the surrogate mother’s existing health insurance policy, probably thorough her employer or her husband’s. Most health insurance policies will cover a surrogate mother, as their own insured, while she is pregnant. It is frankly none of the insurance company’s business how she got pregnant!

But some insurance companies are going out of their way to prevent surrogate motherhood. Take a copy of the surrogate’s insurance benefits booklet to your surrogacy attorney to verify if you can use this policy.

If that doesn’t work, there are a few more ways to obtain surrogate insurance coverage. The easiest, and least expensive at this point is to purchase a regular individual plan from a local insurance agency. Watch, again, for exclusions with surrogate motherhood. Also, sometimes these plans come with a 6-12 month waiting period before they will pay for pregnancy.

It probably should be mentioned that the insurance policy an intended parent carries, most likely through their employment, will not cover the pregnancy of the surrogate mother, regardless of the fact that it is their biological child. The surrogate mother is not the insured party.

There are some surrogacy insurance policies specifically designed for surrogate mothers. These policies really only insure a worst case scenario event, cost thousands to purchase, and come with deductibles in the $5,000-10,000 range. Some intended parents choose to add this sort of policy onto an existing surrogate insurance coverage.

But what happens when a surrogate mother and her intended parents believe that they are covered, get pregnant, and then find out there was an error and her insurance company refuses to cover the pregnancy? Or what if she loses the coverage halfway through the surrogate pregnancy?

There are not too many private insurance companies out there willing to insure a preexisting condition, such as an already pregnant woman. (And if you find one, please let me know!) The options are few in this situation. The intended parents can either pay for the rest of the medical bills in cash, hopefully negotiating a better rate directly with hospitals and doctor’s offices, or they can purchase a discount medical card.

A discount medical card will save the intended parents some considerable money, but it is not the same as having actual surrogate insurance coverage. Still, it’s a terrific option for those in this sort of sticky situation, and can be obtained after the surrogate mother is already pregnant.

Dealing With The Insurance Adjuster After Water Damage

A water damage event his hit your home, and one of the first things you should do is to check your insurance policy or call your insurance agent and determine if your damage is covered. Even though you may be faced with plenty of damage and the beginning of mold, all homeowners policies dont automatically cover all types of water damage.

Once you understand what your policy covers, then you can quickly begin to remediate the damage to your property and begin to get the information to file a claim assuming you know what will be covered, according to the web site insure.com.

First and foremost, as some residents of New Orleans and the Mississippi Gulf Coast learned during Hurricane Katrina in 2005, a flood is not covered by homeowners insurance. Floods are only covered by flood insurance thats issued by the National Flood Insurance Program and cant be bought through nearly any insurance company.

Heres the kicker, though. Flood insurance policies have a ceiling not shared by homeowners insurance, and a separate level for contents that many people dont bother to adjust to their situations. So many homeowners in New Orleans wanted their homeowners insurance to handle the situation, because it provided more coverage.
Water damage from a leaking room is covered by most homeowners insurance, though the damage to the roof is not. Thats because of the generally accepted principle that anything related to maintenance falls to the homeowners. Roofs need to be properly maintained so the roof damage is not allowed.

Likewise, water from an appliance overflowing or pipes freezing and bursting, are both covered. Again, insurance companies general cover water damage if it was a sudden, catastrophic event, and not, as insure.com explains, a gradual wear and tear over time that proper maintenance could have avoided.

And two final areas of water damage: Seepages from the ground into the basement and sewer backup. Neither of these are covered by homeowners insurance. Seepage clearly is a gradual event that can be diagnosed and corrected before any significant damage results. Sewer backup is something that many insurance policies around the country specifically exclude.

So, now you know whether your own water event is covered by homeowners, flood insurance or has to be repaired out of pocket. And you are ready to take the next step – which is to document the damage and get an adjuster to your house as soon as possible to begin the process of submitting an insurance claim.

Refinanced Your Home – Claim a Tax Deduction For Points

The mortgage refinance market has cooled off dramatically with recent rate increases. Many people, however, refinanced during 2005 and can claim tax deductions.

Refinanced Your Home – Claim a Tax Deduction For Points

Mortgage rates have been shockingly low over the last few years. This is hardly news to anyone that owns a home. The nominal rates, however, did result in a major boom for the mortgage industry. As rates jostled up and down, millions refinanced to save just the fraction more on their home loans. Heck, many people refinanced multiple times! Alas, this rapid refinance craze has come to an end with the rise in mortgage interest rates.

If you refinanced this past year to get lower rates, I have some good news. Not only did you get lower rates, but you probably built up some additional tax deductions you can use to cut your tax bill.

To obtain a mortgage, whether new or a refinance, homeowners often have to pay points. These nasty little charges represent a percentage of the loan and are typically an upfront charge. Fortunately, points are deductible. Generally, you will claim a deduction for points as part of the mortgage interest deduction that makes our real estate industry so attractive. The type of loan, however, impacts how the points are deducted.

If you obtained a new home loan for a residence, you can deduct the full amount of the points. To do so, however, you must itemize on your tax return. Since you should be deducting the interest paid on the mortgage as well, this is a no brainer.

If you refinanced an existing home loan for a residence, however, things are a bit different. Yes, you can deduct the points paid on the refinance. Unfortunately, you have to deduct them over the life of the loan. In practical terms, you cannot deduct the full $3,000 you paid in points when you refinanced in August of last year. Instead, you can deduct a percentage of the $3,000. The percentage is the value of the points divided by the number of months of the loan. There are two ways around this tax handicap.

If you refinanced twice in 2005, and some of you did, you can deduct the full amount of the points on the first refinance. Why? You can do this because the life of the first refinance was less than a year, which all occurred in 2005.

In certain cases, points may also be immediately deductible if you used a refinance for home improvements. It is a bit technical and beyond the scope of this article. If you actually used a refinance to improve the home, and you can prove it with receipts, speak with a tax professional to write off all your points immediately.

How To Audit-proof Charitable Donations For Income Tax Season

The IRS means business when it comes to properly documenting donations given to charity. Because of a change in the tax law you must now obtain written documentation for ALL cash donations. Prior to the tax law change if your cash donation was less than $250, you weren’t required to have it substantiated with a receipt from the charity. But now you do. This means all tithes to your church too, that’s if of course, you’re going to claim it as an itemized deduction.

Here’s a suggestion to ensure all of your t’s are crossed and your i’s are dotted in case of an audit. Always maintain good records and do it now instead of procrastinating till the tax deadline is staring you in the face. When you give to your local charity make sure you get a receipt. It must show the charity’s name, the date you contributed and the amount you donated.

Here’s something else you might not be aware of, if you use a credit card to make your charitable donation in 2008, you can claim a deduction even if you don’t pay it off until 2009. Sweet huh?

What if your donation is of the non-cash variety? Well, if you claim a deduction and it’s less than $250 you must get a receipt from the charity. Again, the receipt must show who, when and the amount you donated. If your contribution is over $250 but less than $500 don’t walk away without a contemporaneous written acknowledgment from the charity. In other words, GET A DETAILED RECEIPT!! For taxpayers who can give more than $500 but not more than $5000 you must follow the same rules, but you must file Form 8283, Noncash Charitable Contributions.

And for you blessed taxpayers who give more than $5000 the same rule applies but you must obtain a qualified appraisal. Contributions larger than $500,000 require you to attach a copy of an appraisal to your return.

If you’ll follow the practice of obtaining detailed receipts and keep good records every time you give to a charity, you’ll be able to calmly stand up to any inquiry by the Internal Revenue Service.

Precautions To Take Before Bidding On Tax Foreclosure Properties

As you may already know, tax foreclosure properties are those that have been reclaimed by the local government for failure to pay taxes. The properties are then sold through auctions. While you can find some great deals by opting to purchase these homes, make sure to take a few precautions before you begin bidding.

Check Out the Property

If possible, you should try to see the property before you place a bid on it. As with other types of foreclosed homes, tax foreclosure properties are often not left in great shape by the past owners. To some extent, you can understand the bitterness and anger involved in having your home taken away but when youre the one purchasing the property and having to sink a lot of money into the home to repair ridiculous and deliberate damage it can also be frustrating.

By looking at the property before bidding, you can more accurately determine a maximum threshold for bidding. For example, if $20,000 in repairs are going to be needed, you may want to lower that upper bid level by about that much.

Check for IRS Liens

While local tax liens take precedence over mortgages and other types of liens that might tangle up the title to the property, claims on the property placed by the Internal Revenue Service cannot be so easily dismissed. Before bidding, you may want to do a check on the title of the property to make sure no IRS liens are present. Otherwise, you could find yourself owing someone elses tax bills and having to take the old owners to court to recoup your losses.

When youre purchasing tax foreclosure properties, you want to get the best deal possible so take the precautions listed above to make sure your purchase doesnt end up costing you more in the long run.

Tax Credits For Truck Drivers

Truck drivers, whether they are owner-operators or drive professionally for an organization, can deduct a number of on-the-road expenses on their federal income taxes. Special rules apply to truck drivers; The IRS recognizes the importance of trucking in the national economy and acknowledges there are many expenses incurred in the profession. Owner-operators are afforded a few more deductions to subsidize the expense of owning and operating their semitrucks.

Equipment and Related Expenses
Owner-operators garner the largest deductions in the equipment and equipment-related expenses category. According to the federal tax code’s Section 179 Deductions for Tangible Property, a truck owner does not have to depreciate his truck over the long term, but may instead be able to make a large one-time deduction. The maximum Section 179 expense deduction for qualified real property is $250,000. Repairs and maintenance to the truck may also be deducted. Truckers are allowed a deduction for gas expenses and the purchase of products related to the operation of the truck as well.

Communication Expenses
Because truckers are on the road for the majority of their work time, they often spend a great deal on communication expenses. Expenses such as cellphones, cellphone service, CB radios, satellite networks for computers, computer software and laptops may all be included as business-related expenses and are deductible at a percentage of their original cost. If you use your cellphone for personal use as well, you may only deduct business-related usage.

Personal Expenses
Personal expenses for truck drivers differ from those for businesspeople who are traveling. Truckers often sleep in their trucks instead of paying for a hotel. If you purchase a sleeping bag, bunk, blankets, hot pot or truck stop showers, you can deduct all of these as business- related expenses. Trucking companies will sometimes pay drivers a per diem for food. In these circumstances, the driver cannot deduct the amount of the per diem, but may be able to deduct meals that exceed the per diem up to the IRS limit. Owner-operators who do not receive a company per diem to cover food may use the special deduction for employees involved in transportation. As a truck driver as of 2010, you can claim a standard meal allowance of $59 a day ($65 for travel outside the continental United States). Truckers should verify these deductions annually as they are often modified by the IRS.

Considerations
Throughout the year, as you conduct your duties as a company truck driver or an owner-operator, you will encounter expenses. To get the most out of your tax deductions, you need to keep and organize all receipts that are business related. Purchasing an expandable file folder and files is an easy way to organize your receipts. Label files according to the nature of the receipts; truck repairs and maintenance, food, lodging, communication and perhaps miscellaneous. If you don’t have an official receipt, include a handwritten receipt with the amount of purchase, date and what it was for.
